THESE OFFICIAL TERMS & CONDITIONS CONTAIN AN ARBITRATION AGREEMENT, WHICH WILL, WITH LIMITED EXCEPTION, REQUIRE YOU TO SUBMIT CLAIMS YOU HAVE AGAINST SPONSOR TO BINDING AND FINAL ARBITRATION.  UNDER THE ARBITRATION AGREEMENT, (1) YOU WILL ONLY BE PERMITTED TO PURSUE CLAIMS AGAINST SPONSOR ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, AND (2) YOU WILL ONLY BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ON AN INDIVIDUAL BASIS. 

 

1. 1. The following terms and conditions (“Terms”) apply to the Ono Hawaiian BBQ Waikiki Getaway Sweepstakes (“Sweepstakes”) sponsored by Ono Management LLC, a Delaware limited liability company located at 1315 Valley Vista Drive, Diamond Bar, California 91765 (“Sponsor”).  NO PURCHASE IS NECESSARY TO ENTER OR WIN THE SWEEPSTAKES.  THE ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED.   
   2. Eligibility:  Participation in the Sweepstakes is limited to residents of Texas, California, and Arizona who must be at least 18 years old.  Employees, independent contractors, interns, officers, directors, and agents of Sponsor and Sponsor’s parents, affiliates, subsidiaries, advertising and promotion agencies, suppliers, directors, owners, and their immediate family members and/or those living in the same household of each are not eligible to participate.  Void where prohibited. 
   3. To enter the Sweepstakes:

• • • • You must pass any verification requirements (email or fraud score) set by Sponsor.   

• • • • Limit one entry per person.  You may not submit multiple entries by using multiple email addresses, identities, or devices. 

By entering, the Sweepstakes, You: (a) represent and warrant that You meet the eligibility requirements; (b) represent and warrant that You have affirmatively reviewed, accepted, and agreed to all of the Terms; (c) agree to comply with and abide by these Terms; and (d) agree to accept Sponsor's decisions relating to the Sweepstakes as final and binding.  Eligible entries must be complete and fulfill all Sweepstakes requirements and these Terms.  Sponsor has sole discretion to omit or disqualify any entries that are incomplete or conflict with the Sweepstakes requirements or these Terms.   

4. Entry Period:  The Sweepstakes entry period starts July 22, 2026 at 12:00AM PST and ends July 29, 2026 at 11:59PM PST (“Entry Period”).  Only entries submitted during the Entry Period will be eligible for the Sweepstakes. 

5. Prize:  The Sweepstakes will have one (1) winner (“Winner”) who will receive a prize travel package (“Prize”) with the following:  

• • • • 3 nights’ stay at Outrigger Waikiki Beachcomber Hotel in Honolulu, Hawaii (valued at $2667) (valid for one (1) year following Entry Period) 

• • • • 2 tickets to Cirque du Soleil’s ‘Auana performed at Outrigger Waikiki Beachcomber Hotel in Honolulu, Hawaii (valued at $220) (valid for one (1) year following Entry Period) 

• • • • 1 Southwest Airlines $1500 flight voucher for two passengers to Oahu 

Approximate retail value (“ARV”) of the Prize is $4400.  Any expenses related to redemption or use of the prizes, including state and local taxes, are the sole responsibility of Winner.  The Prize is not redeemable for cash, and Winner may not transfer the Prize to any other party.  There are no substitutions for any portion of the Prize, except at Sponsor’s sole discretion, and any substitutions must be of equal or greater value.  Fulfillment of the Prize may be subject to availability, scheduling restrictions, or time limits, as determined by Sponsor and the Prize providers. 

6. Winner Selection and Notification: Winner will be selected by a random drawing supervised by Sponsor on July 31, 2026.  Winner will be notified within 5 days of the random drawing based on the information provided in Winner’s entry form.  Sponsor shall have no liability for a Winner's failure to receive notices due to spam, junk e-mail or other security settings, or due to Winner providing incorrect or non-functioning contact information in the entry process.   

7. Prize Acceptance:  Winner must verify acceptance of the Prize and fulfill all terms of acceptance within five (5) days after Sponsor sends notice of winning (“Acceptance Period”).  If a Winner cannot be contacted, is ineligible, fails to accept the Prize, or fails to fulfill the terms of acceptance for the Prize within the Acceptance Period, then the Prize may be forfeited, and Sponsor may select an alternate Winner by a subsequent random drawing.  Winner’s receipt of the Prize is conditioned upon compliance with federal, state, and local laws and regulations.  If a Winner violates any of these Terms or any applicable law or regulation in accepting the Prize, then Sponsor may disqualify such Winner in Sponsor’s sole discretion and remove or terminate any portion of the Prize, at any time.  Sponsor owes Winner no obligation, reimbursement, alternative prize, or other item of value if Winner is unable to accept, fulfill, or use the Prize for any reason. 

8. Warranty and Indemnification by Entrants:   

• • • By entering the Sweepstakes, You represent and warrant that You are permitted to enter and provide all information in Your entry.  You shall indemnify, defend, and hold harmless Sponsor from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Sponsor may incur for any breach of this warranty. 

• • • By entering the Sweepstakes, You understand and agree that if You are a Winner, then Sponsor and anyone acting on behalf of Sponsor or its respective licensees, successors, subsidiaries, parents, beneficiaries, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media, now known or hereafter developed, in perpetuity and throughout the world, without limitation, Your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent from You.  

9. Sponsor may, in its sole discretion:  cancel, terminate, modify, or suspend the Sweepstakes to uphold the administration, security, fairness, or proper conduct of the Sweepstakes and entrants; disqualify or pursue legal action against any party attempting to alter the Sweepstakes process, administration, or operation; or void entries that violate or conflict with these Terms, including without limitation multiple entries from the same user or computer or entries submitted by bots, macros, scripts, or other technical means.   

10. Limitation of Liability:  By entering the Sweepstake, You agree to defend, indemnify, and hold harmless Sponsor and its parents, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, beneficiaries, alter egos, assigns, employees, owners, officers and directors from any liability, illness, injury, death, loss, litigation, claim, or damage (collectively, “Claims”), regardless of how caused, arising directly or indirectly from: (i) Your participation in the Sweepstakes and/or Your acceptance, possession, use, or misuse of the Prize or any portion thereof; (ii) unauthorized human intervention in any part of the Sweepstakes; (iii) electronic or human error in the administration of the Sweepstakes or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail; or (viii) any issue with the availability of the Prize or the ability of the Prize providers to issue the Prize to You.   

11. ARBITRATION AGREEMENT: PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.

a. Agreement to Arbitrate:  This Section is referred to in these Terms as the “Arbitration Agreement.”  You agree that any and all disputes or claims that have arisen or may arise between You and Sponsor, whether arising out of or relating to these Terms, the Sweepstakes, Your participation in the Sweepstakes, the Prize, acceptance, possession, use or misuse of the Prize (including any alleged breach thereof), any advertising, or any aspect of the relationship between You and Sponsor, shall be resolved exclusively through final and binding arbitration, rather than in court, in accordance with the terms of this Arbitration Agreement, except that You may assert individual claims in small claims court, if Your claims qualify.  Further, this Arbitration Agreement does not preclude You from bringing issues to the attention of federal, state or local agencies, and such agencies can, if the law allows, seek relief against Sponsor on Your behalf.  You agree that, by participating in the Sweepstakes, You and Sponsor are each waiving the right to a trial by jury or to participate in a class action.  Your rights will be determined by a neutral arbitrator, not a judge or jury.  The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.

b. Prohibition of Class and Representative Actions and Non-Individual Relief:  YOU AND SPONSOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.  UNLESS BOTH YOU AND SPONSOR AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S OR PARTY’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING.  THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S). 

c. Pre-Arbitration Dispute Resolution:  Sponsor aims to resolve disputes amicably and efficiently, and concerns relating to the Sweepstakes can be resolved by emailing customer support at [email protected].  If issues are not resolved through such correspondence, then a party intending to pursue arbitration must first send to the other, by certified mail, a written Notice of Dispute (“Notice”).  The Notice to Sponsor should be sent to: Ono Management LLC, Attn: Sweepstakes, 1315 Valley Vista Drive, Diamond Bar, CA 91765 (“Notice Address”).  The Notice must (i) describe the nature and basis of the claim or dispute and (ii) set forth the specific relief sought.  If Sponsor and You do not resolve the dispute within sixty (60) days after the Notice is received, You or Sponsor may commence an arbitration proceeding.  During the arbitration, the amount of any settlement offer made by Sponsor or You shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which You or Sponsor is entitled.

d. Arbitration Procedures.  Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association’s (“AAA”) rules and procedures (collectively, “AAA Rules”), as modified by this Arbitration Agreement.  Information on the AAA is available on its website:  http://www.adr.org.  For any inconsistency between AAA Rules and any term of this Arbitration Agreement, this Arbitration Agreement’s terms will control, unless the arbitrator determines that their application would not result in a fundamentally fair arbitration.  The arbitrator must also follow these Terms as a court would.  All issues are for the arbitrator to decide, including, but not limited to, issues relating to the scope, enforceability, and arbitrability of this Arbitration Agreement.  Although arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings, the arbitrator can award the same damages and relief on an individual basis that a court can award to an individual under these Terms and applicable law.  Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons.  Unless Sponsor and You agree otherwise, any arbitration hearings will take place in a reasonably convenient location for both parties with due consideration of their ability to travel and other pertinent circumstances.  AAA may facilitate selection of or determine the location as needed.  If Your claim is for $10,000 or less, Sponsor agrees that You may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing as established by AAA Rules.  If Your claim exceeds $10,000, the right to a hearing will be determined by AAA Rules.  Regardless of how the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which any award is based.

e. Costs of Arbitration.  Payment of all filing, administration, and arbitrator fees will be governed by AAA Rules, unless otherwise provided in this Arbitration Agreement.  Any payment of attorneys’ fees will be governed by AAA Rules.

f.  Confidentiality.  All aspects of the arbitration proceeding, and any ruling, decision, or award by the arbitrator, will be strictly confidential for the benefit of all parties. 

g. Severability.  If a court or the arbitrator decides that any term of this Arbitration Agreement other than subpart (b) above is invalid or unenforceable, the parties agree to sever and replace such term with a valid enforceable term that satisfies the intent of the severed term to the extent possible.  If a court or arbitrator decides that any portion of subpart (b) is invalid or unenforceable, then the entirety of this Arbitration Agreement shall be null and void.  The remainder of these Terms will continue to apply.

h. Conflict:  For any conflict between any term of this Section 11 and any term found in another location on Sponsor’s website, or in Sponsor’s Terms of Use or Privacy Policy, then the applicable term in this Section 11 shall control.

i.  This Arbitration Agreement does not limit either You or Sponsor from seeking injunctive relief as provided in the Terms.

12. Information submitted with an entry may be subject to Sponsor’s Privacy Policy at onohawaiianbbq.com/privacy-policy/.

Raffle Terms and Conditions

4. Entry Rules: Only one raffle ticket per person is allowed. Participants found using multiple tickets will be disqualified. Ono is not responsible for lost or missing raffle tickets.

6. Changes to Raffle: Ono Hawaiian BBQ reserves the right to cancel, modify, or reschedule the raffle at any time without prior notice.
